Darbk Store is an online store specializing in providing tires bearing our "Darbk" trademark. We offer online, retail, and wholesale sales services, along with a warranty service for tires in accordance with our warranty policy. We provide Darbk Store services to retail and wholesale customers under the following terms and conditions:

First: Definitions

In this agreement, unless the context otherwise requires, the terms referred to in this section shall have the meanings set forth next to each term, as follows:

“Darbk,” “Darbk Store,” “The Store,” “We,” “Us,” or “Our”: refers to the website Darbk.com and Darbk Store, the owner of the "Darbk darbk" trademark in the Kingdom of Saudi Arabia, the partners in Darbk Store, and all persons authorized by them to provide services to customers, conclude contracts, and deal with the competent authorities.

“User,” “You,” or “Your”: refers to the person who visits or uses Darbk Store, communicates with us through Darbk Store or any of its available communication channels, requests to purchase the tires we provide, or enters into this agreement or any of our policies.

“Client” refers to any natural or legal person (establishment, company, any commercial or non-commercial entity) who requests to purchase our tires offered for sale through Darbk Store, whether an online, retail, or wholesale customer.

“Tires” or “Products” refers to the tires offered for sale through Darbk Store, which may be available from time to time with the specifications and prices advertised on each product page or with the prices and specifications available in the price quotes we send to our customers.

“Pre-booking” refers to the pre-booking service provided by Darbk Store, through which the customer can (request tires, visit to see tires, inquire about tires).

“Price Quotes” refers to the price quotes we provide to customers when communicating with them about our products, which may include item prices, discounts, shipping costs, payment fees, and other financial costs related to the order.

“Order” refers to the total tires that the customer requests to purchase from Darbk Store, for which an invoice is issued and which are shipped to the customer by our approved shipping team.

“Warranty” refers to the warranty service provided by Darbk Store to customers for tires purchased through us, which are subject to our warranty policy that includes the terms and conditions for benefiting from the warranty service.

“Shipping” refers to the tire shipping service provided by Darbk Store to customers, which may be carried out by the store's team or through a shipping company provided to deliver tires to customers.

“Invoice” refers to the electronic invoice issued by Darbk Store's electronic system or the printed invoice we provide, which includes a statement of tires, quantities, prices, tax, and the final amount the customer is obligated to pay to the store.

“Value Added” refers to the Value Added Tax (VAT) applicable in the Kingdom of Saudi Arabia, which is a percentage of the value of the tires determined by each state on sales purchased by the customer through Darbk Store. The customer is obligated to pay this tax through Darbk Store as part of the invoice, and Darbk Store remits it to the competent tax authorities. The store collects the tax if we are obligated to register for VAT according to the applicable statutory provisions in the Kingdom of Saudi Arabia.

“Content” refers to all texts, graphics, photographs, videos, information, data, numbers, logos, illustrations, explanations, data, and other materials provided by Darbk Store, on or through Darbk Store's services, in addition to their selection, compilation, and arrangement.

“Agreement” refers to the Terms and Conditions, Privacy Policy, Warranty Policy, and all independent or embedded policies within any of the documents we provide that govern the legal relationship between Darbk Store and any of our users and customers, including all instructions, guidelines, and notices that contain supplementary information for the implementation of any provisions of this Agreement, as well as printed or electronic contracts.

“Regulations” refers to the regulations in force in the Kingdom of Saudi Arabia.

Second: Darbk Services

Darbk Store is an online store specializing in selling tires under our own brand. Through Darbk Store, we offer a pre-booking service that allows you to send a request to the store with your contact details, so our team can contact you and send price quotes.
Darbk Store offers multiple payment methods suitable for all our customers. Darbk Store also provides shipping and delivery services through our own team or through specialized shipping companies for goods delivery.
Darbk Store provides a warranty service for tires according to specific controls and conditions. To benefit from the warranty, you must review Darbk Store's warranty policy.

Third: Provisions of the E-commerce System (2019 AD, 1440 AH)

Darbk Store is committed at all times to fulfilling the legal obligations approved by the executive authorities in the Kingdom of Saudi Arabia. Darbk Store declares its full commitment to the e-commerce system and its executive regulations, and accordingly:

Darbk Store conducts business in accordance with the regulations in force in the Kingdom of Saudi Arabia. Darbk Store also carries out all its activities after obtaining the necessary licenses for e-commerce and entering into this agreement with the customer.
Darbk Store provides services and tires in accordance with the regulations in force in the Kingdom of Saudi Arabia. Darbk Store clearly and explicitly advertises prices and undertakes that these advertisements are legal, truthful, and accurately represent the advertised tires.
Darbk Store delivers tires to the customer on the agreed-upon delivery date, according to the specifications advertised on the sales page, and the delivery is carried out professionally in accordance with the provisions of this agreement.

Fourth: Provisions of the Personal Data Protection System (1443 – 2021)

Darbk Store adopts a privacy policy to ensure the protection of customer data and any store user. In this policy, we clarify all practices we may undertake regarding customer and user data. The store complies with the Saudi Personal Data Protection System and its executive regulations concerning the collection and processing of all user-related data.

Fifth: Legal Scope of Our Services

Darbk Store operates as an online store for selling our tires. It serves as our advertising platform, through which we publish all information regarding the tires offered for sale, to inform the customer of the specifications upon which they base their purchase decision.
Advertisements for tires published through Darbk Store are considered an "invitation to treat" and not a "binding offer." The contract with the customer is concluded upon their submission of a purchase order and our subsequent acceptance of that order, based on the availability of the tires.
We offer various sales services, including retail, wholesale, and online sales. Customers benefit from our sales services in accordance with the legal provisions governing each sales system.
Our services integrate with third parties such as shipping and delivery companies and electronic payment service providers. To facilitate this integration, you agree to deal with these companies according to their respective systems, policies, and terms.
Darbk Store's responsibility is limited solely to the services and tires we provide. Consequently, we do not accept any errors or legal liability arising from the fault of others, including any person, entity, or third party, and the customer absolves us of responsibility for such.

Sixth: Consent and Eligibility

(1) Legal Capacity of Individuals:

The user/customer of Darbk Store acknowledges that they have full, unrestricted legal capacity to enter into this agreement with us, in accordance with the applicable regulations in the Kingdom of Saudi Arabia.
Your use of the store's services requires you to be 18 years of age or older, or the legal age required according to the applicable regulations in the Kingdom of Saudi Arabia and the Arab Gulf states. You acknowledge reaching this legal age, and the store bears no responsibility or obligation to verify the data and documents proving you have reached this legal age.
If the user/customer is below the required legal age according to the terms and conditions of this agreement, they must use Darbk Store under the supervision of a parent. In all cases, the legal guardian or custodian shall be legally responsible for all actions of the user under their guardianship.
The user/customer of Darbk Store acknowledges that they are not afflicted by any impediment to legal capacity, possess full mental faculties, and are capable of comprehension and discernment to be able to conclude legal actions through the store.
Darbk Store reserves the right to terminate the agreement, cancel membership, or suspend it if it is proven to the store at any time that a Darbk Store user does not meet any of the aforementioned conditions.

(2) Legal Status of Establishments and Entities:

If the user is a commercial or non-commercial establishment or entity and wishes to use Darbk Store to benefit from any of our services, the store must be used by the legal representative of that entity or establishment. The legal representative shall be solely responsible before the online store for all transactions and activities conducted through it.
The legal representative acknowledges that the establishment or entity they represent conducts its activities in accordance with applicable regulations. They also acknowledge that the establishment or entity they represent holds the necessary licenses and permits, is registered in accordance with the regulations governing trade or activity, and possesses a commercial registration specific to its activity or a valid license at the time of entering into this agreement and throughout the duration of our contractual relationship.
Darbk Store reserves the right at any time to request all documents, papers, records, and licenses proving the legal status of commercial establishments and non-commercial entities that enter into this agreement with us, whether during the registration process or at any time thereafter.

Seventh: Digital Signature

Your use of the store in any manner or your request to purchase our tires constitutes an electronic signature on this agreement, replacing any required consent, handwritten signature, or other electronic signature. It signifies your explicit consent to all terms and policies contained herein. This agreement becomes effective against you upon your use of the store, and you are bound by all obligations contained within it, as well as by the privacy policy and all practices, terms, and clauses stated therein.

This agreement constitutes the final agreement between Darbk Store, on the one hand, and any person who visits, uses, requests to purchase tires through, or utilizes any of its features or functionalities, on the other hand.
This agreement constitutes a valid electronic contract, complete in its legal terms and elements, possessing the same binding force as written contracts. It is enforceable against all mentioned parties, and its provisions and obligations are binding on all of them. No party may be released from or terminate it as long as it has produced its legal effects.
All users and customers acknowledge that this agreement constitutes the entire agreement between them and Darbk Store, and they have agreed that they have not relied on any representations, whether oral or written, in agreeing to this agreement other than the provisions set forth herein.
The description of services and sub-pages of Darbk Store prepared by Darbk Store are an integral part of this agreement. Furthermore, supplementary contracts to this agreement, signed with any users and customers, are also an integral part thereof, and the terms and conditions applicable to this agreement shall apply to them. They are inextricably linked to this agreement, existing and ceasing to exist with it.

Amendments to this agreement shall have the same legal force and effect as this agreement. Additionally, supplementary provisions and policies shall have the same binding legal force as this agreement and any physically signed contracts.

The customer must meet all statutory requirements and conditions stipulated in the regulations applicable in the Kingdom of Saudi Arabia, in addition to those set forth in this document and the following terms and conditions:
The customer must possess full legal capacity required to enter into purchase contracts. By entering into this purchase agreement, the customer affirms that they have the necessary legal capacity to conclude a tire purchase contract. The customer is bound by all policies followed by Darbk Store within this agreement, and must also comply with all provisions of applicable laws, decrees, and regulations.
The customer understands and agrees that Darbk Store is dedicated to selling our tire products advertised through Darbk Store, and does not offer any other products beyond those available through Darbk Store.
The customer may be able to make tire purchases through Darbk Store wherever these tires are available from Darbk Store and its sales departments. You acknowledge that you are purchasing the tires according to the terms and conditions specified by Darbk Store, including any special requirements related to usage.
The customer is obligated to review the displayed tires and accurately identify the tires they wish to purchase according to the specifications provided and available on the store's pages by Darbk Store management, or those sent to the customer after communication, in accordance with our operational mechanisms, before submitting a purchase order. Orders are accepted after an offer and acceptance by Darbk Store and the customer, and their consent is declared through Darbk Store.
The customer undertakes to pay the price of the tires advertised on Darbk Store through the approved payment methods on Darbk Store, in accordance with our approved payment policy. The customer pledges not to dispose of or sell the purchased tires until their full price, plus shipping fees, has been paid. The customer also undertakes to complete payment processes if a partial payment was made in error.

All prices are determined by us through Darbk Store and are final in the relationship between Darbk Store and the customer. These prices are subject to our pricing policy.
Darbk Store reserves the right to obtain proof of the validity of the payment details provided by the customer at any time before our staff ships the tires, in order to prevent fraud and falsification of transfer documents.
Darbk Store reserves the right at any time, either before the purchase process or before tire delivery, to request the customer to provide more details and clarifications regarding the product delivery address or contact information, to enable the shipping team to communicate with the customer and deliver the products as quickly as possible.
Tires are delivered to the customer upon their request, and the customer assumes full legal responsibility for the tires after receiving them from the store's staff. Upon receiving the tires, the customer must verify their condition and conformity to specifications immediately. Darbk Store does not guarantee against defects that are customarily tolerated, nor does the store bear any responsibility related to usage.
The customer must notify Darbk Store of any defect discovered in the tires according to the timelines specified in the return policy, provided that the return is made in accordance with the regulations set forth in our return policy.
If the customer refuses to accept delivery of the tires at the specified delivery time, they shall be bound by all obligations stipulated in this agreement, including financial obligations and any other procedures set forth in this document.
Prior to the delivery date of products sold to the customer, and in the event of the customer violating the purchase provisions outlined in this agreement, the store reserves the right to cancel this agreement with immediate effect, without any notifications, warnings, or legal proceedings. Darbk Store also retains the right to seek appropriate compensation for any damages incurred.
The customer must use the products lawfully and is prohibited from using them for illegal purposes or purposes that violate conditions specified by the competent authorities. Upon receiving the products, the customer must comply with all instructions regarding their use.
Buyers are permitted to submit ratings for purchases and review products bought through the store. The customer undertakes not to abuse this right and ensures that all reviews are honest and accurately reflect the service performance.
You acknowledge that the content published on Darbk Store is for informational purposes only, and the product data published through Darbk Store belongs to the store and its owner. Furthermore, the opinions and comments posted on Darbk Store are those of the individuals who publish the content and may not reflect our own views.
Darbk Store management reserves the right to retain the customer's personal information or share it with security agencies and relevant government entities if requested by any of these parties. The management of customer data is also subject to our approved privacy policy.
Darbk Store management reserves the right to withhold funds or physical assets whenever necessary to settle any dispute of any kind involving the customer, while complying with any decisions issued by the competent authorities.
Darbk Store reserves the right to implement any technical measures that restrict total or partial access to Darbk Store's services, whether temporarily or permanently, in the event of a violation of any of the terms and conditions of this agreement, without prior warning or notification.
By agreeing to the terms and conditions and privacy policy, or by placing an order to purchase products through Darbk Store, the customer acknowledges commitment to all conditions outlined in this agreement. The customer also understands that Darbk Store management reserves the right to amend, add, or delete any of these conditions, and therefore, this agreement should be reviewed periodically.

Tenth: Sales Policy (Retail, Wholesale, Online)

The store displays products on its pages according to specified classifications and categories. We provide one or more illustrative images for each product. This image is not necessarily of the exact product to be delivered to the customer but represents the product type or model.
Through the store or via price quotes, we provide an accurate product description, detailing its characteristics and features that customers wish to know before making a purchase. We also list product prices on the store, and product pricing is subject to our pricing policy in accordance with the provisions of this agreement.
Products are ordered according to Darbk Store's approved procedures. The customer selects the product, requests a pre-booking, and places a purchase order. The store then provides and delivers the product to the customer after payment. The electronic sale process is contingent on the availability of products at Darbk Store. The customer exempts Darbk Store from any liability if we are unable to verify the customer's information and address, if there is suspicion that the order may pose a credit card fraud risk, or if all or some of the requested products are unavailable or out of stock.
Darbk Store reserves the right to accept, reject, or cancel a customer's purchase order in certain situations, such as: if the desired product is unavailable, if the product was incorrectly priced, or if we discover at any time that the customer's order is fraudulent or illegal. In all such cases, Darbak Store will refund the amount paid by the customer using the original payment method.
Should the customer fulfill all payment obligations and Darbk Store be unable to deliver the purchased products by the scheduled delivery date due to circumstances beyond our control, we will propose an alternative delivery date, if feasible, or suggest a substitute product. If the customer does not agree, they may then notify Darbk Store to terminate the sale.
Upon submitting a purchase order and receiving the invoice and products, the customer acknowledges agreement to the items listed on the invoice and full knowledge of all their specifications. Darbk Store is not obligated to provide any additional features or characteristics for products sold after their delivery to the customer, nor does Darbak Store guarantee that the products will meet all customer expectations. Consequently, the customer accepts the products in their condition at the time of purchase, in accordance with the agreed-upon specifications.
Darbk Store does not guarantee the customer's ability to market the products purchased through Darbk Store, nor does it guarantee their popularity or the generation of profits from their resale. All such outcomes depend on the customer's own marketing strategy.
Darbk Store retains ownership of all content related to the products, including all images and visual files, and reserves the right to publish them at any time. Your purchase of any products does not grant you the right to use, distribute, or republish our intellectual property rights associated with the products we provide.
The customer uses the products we provide at their own risk. Darbk Store offers no guarantees regarding the products other than those explicitly advertised through Darbk Store. Darbk Store is committed to providing the product in accordance with the description specified on the store. Darbk Store bears no legal responsibility for any damage to the products resulting from misuse, improper storage by the customer or product users, or negligence in their use. In such cases, Darbk Store will not be obligated to replace or refund the products.
In all cases, to benefit from the products we provide, the customer must adhere to the terms and conditions outlined in this agreement. The store reserves the right to cease delivery of products to the customer if they violate any of these terms and conditions.

Eleventh: Pricing Policy

Prices and payments through Darbk Store are set in the local currency of Saudi Arabia (Saudi Riyal). Consequently, Darbk Store is not obligated to accept payments in other currencies not accepted by the store.
Darbk Store prices all tires available on its store pages according to our pricing policy. You understand and agree that the prices displayed through Darbk Store are our own, and you accept to purchase based on these prices. We, in turn, strive to offer the best prices to our customers.
Darbk Store does not guarantee that our prices are the lowest in the local or global market, as various factors influence pricing.
We reserve the right, at any time and without prior notice, to adjust prices available through Darbk Store to account for increases in costs, prices, government or customs fees, or any other reasons. These price adjustments will apply to new orders and existing orders affected by the increase before delivery to the customer.
We reserve the right to adjust prices for undelivered orders at Darbk Store's discretion. Customers who have already paid will then have the option to accept the new prices or cancel their order.
Errors may occur in quoted prices. In such cases, Darbk Store reserves the right to adjust prices at any time and to halt the delivery of any order purchased based on incorrect pricing.
Prices may vary from time to time at our discretion. We reserve the right to adjust prices available through Darbk Store at any time, whether by increasing or decreasing them.

Twelfth: Advance Booking Policy

Darbk Store offers customers an advance booking service, which provides several benefits subject to the following terms and conditions:

You understand and agree that the advance booking service offers options to request tires, schedule a visit to view tires, or inquire about specifications. This service does not constitute a direct product order. Our sales team will contact you if you wish to order tires. Therefore, an advance booking is not a legally binding purchase order but rather an expression of interest, based on which we will contact you to provide a price quote and final product specifications.
You agree to provide the necessary information for the advance booking service by completing the application form (name, mobile number, email) and selecting the desired service. Our team will then contact you using the details you provided. For some messages that do not require direct team interaction, we may use an automated response service.
You acknowledge that all data provided through the advance booking service is yours, valid for use, and authorized for receiving messages. Should this not be the case, you assume full legal responsibility, and we bear no liability.
There may be delays in contacting you due to reasons beyond our control, such as a high volume of booking requests, public holidays, or heavy workload. Rest assured, Darbk Store will make every effort to contact you as soon as possible.
We may be unable to contact you after booking if the provided email address or mobile number is invalid for receiving messages from our team.

Thirteenth: Viewing Policy

We offer our customers the opportunity to view the tires we provide through the following methods:

To visit one of our branches, you can pre-book an appointment through our advance booking service. Viewings under this service are subject to the following conditions:

Customers must not damage the tires in any way, whether by conducting practical experiments or any unauthorized use during their visit.
When handling tires, customers must ensure no materials or liquids that could leave marks are present, and avoid using any sharp objects.
If you have any requests, issues, inquiries, or wish to photograph tires, please contact the responsible employee at the branch.

Electronic inspection of tires is conducted by viewing the high-resolution images we provide on our website or send through any other communication channel. Electronic inspection is subject to the following conditions:

We provide images, information, and all specifications to inform the customer about the appearance and specifications of the tires they wish to purchase from us. Therefore, the customer must review the complete specifications before purchasing.
The customer acknowledges and agrees that the images we provide are taken from a product similar to the tires the customer will purchase from Darbk Store and are not necessarily of the exact tires that will be delivered to the customer.
The customer acknowledges and agrees that slight color variations may occur due to lighting conditions during photography or the device used to view the tires.

Fourteenth: Installation Policy

Darbk Store provides sales services only, whether retail, wholesale, or online. Darbk Store does not offer any tire installation services, and the role of its team is limited to delivering tires to customers only.
Tire installation is carried out by the customer themselves, and the customer must seek assistance from specialists for tire installation. Installation is the sole responsibility of the customer, with no liability whatsoever on Darbk Store.
The customer bears all consequences and damages arising from any errors related to tire installation on vehicles, including any damage to the tires or any other damage to vehicles or individuals.

Fifteenth: Payment Policy

Customers can pay using the electronic and non-electronic payment methods we provide through Darbk Store. The store reserves the right to update payment methods at any time, and we may also designate certain payment methods for specific transactions, regions, or customers as we deem appropriate.
The payment methods used by the customer must be legal, and the purpose of payment through Darbk Store must not be money laundering or any other illegal exploitation. The customer may be asked to prove ownership of the payment method to complete the transaction through us.
The customer must confirm their selected order before making payment through Darbk Store. Payment constitutes final approval of the tire value, and the customer is not entitled to cancellation or return except in accordance with the provisions of this agreement.
An electronic invoice will be issued for the value of the tires + the applicable Value Added Tax (VAT) on tires purchased by the customer through Darbk Store (if applicable). The customer is responsible for any additional prescribed fees, such as customs duties.
Fees may be imposed on payment transactions made through Darbk Store. The customer is responsible for electronic payment gateway charges, which may vary from time to time and depending on the contracted electronic payment service provider.
Customers must make payments directly through the designated payment pages. Customers are prohibited from entering their data on any intermediary pages or using any intermediary applications, software, or websites to ensure the security of their electronic payment data.
The store reserves the right to update and amend its payment policy at any time without requiring the consent of any Darbk Store users.

Sixteenth: Shipping Policy

The customer must adhere to Darbk Store's shipping policy, which may change from time to time. Darbk Store provides delivery and shipping services to cities within the Kingdom of Saudi Arabia through its own team or through contracted shipping companies. Shipping services may be available in some areas but not others, according to the store's approved shipping and delivery plan.
Shipping costs are determined based on the shipping location and distance and will be added to the invoice. Should any shipping offers become available, we will communicate them directly to the customer, noting that such offers are temporary.
When you make a purchase through the store, we will prepare the order, and the shipping and delivery date will be arranged with the customer by Darbk customer service. The delivery date must fall within official working days. The store is committed to delivering tires on the agreed-upon date; however, circumstances beyond our control may occur, in which case we will notify the customer of the probable delivery date. In all cases, Darbk Store is not responsible to the customer for any delay in tire delivery due to force majeure.
During the delay period, the customer's payment responsibilities are suspended until the force majeure circumstances are resolved. After the force majeure circumstances are resolved, the customer's payment obligations resume.
If the customer fails to receive the products without a convincing reason acceptable to Darbk store management, the store reserves the right to deduct the shipping cost and any related fees.
The customer undertakes to treat the shipping representative respectfully and bears all legal responsibilities for any personal misconduct against the shipping representative. Darbk store also disclaims responsibility for any personal misconduct committed by the shipping representative against the customer.
Darbk store reserves the right to change and update the shipping policy from time to time. Therefore, you should review this policy every time you make a purchase through the store.

Seventeenth: Return Policy

Darbk store is committed to providing an excellent shopping experience for its valued customers. Therefore, we allow customers to request a return of tires purchased through the store, in accordance with the following terms and conditions:

(1) Return of Non-Defective Tires at Customer's Request:

We allow customers to return tires purchased through Darbk store within 7 days from the date of receipt, provided the products are not defective. The following conditions apply for return acceptance in this case:

The customer must not use the products in any way or derive any benefit from them.
The customer must not install the products or attempt to install them.
The customer must not damage or harm the products in any way.
The customer must not open or attempt to open the packaging or containers, or damage or harm the product's packaging.
The customer must not remove any of the product's serial numbers, if applicable.
The customer must return the product in the condition in which it was received, along with all accessories, gifts, manuals, instructions for use, warranty, and other attachments.

(2) Return of Defective or Non-Conforming Tires:

The customer has the right to request a return of tires in the following cases:

Receiving products that do not match the description specified in the purchase order.
Receiving defective or damaged products.
Receiving an incomplete order (not receiving some of the tires paid for through the store).

(3) No Returns Accepted:

Darbk Store does not accept return requests in the following cases:

Products whose packaging or containers have been opened by the customer, tampered with, or from which any accessories or attachments have been removed.
Products that the customer has installed or attempted to install.
Products that have been previously used, damaged by the customer, or are no longer in their original condition.
Products from which serial numbers or any attached data have been removed.
For wholesale sales, the store does not accept returns for orders that have been shipped and delivered to the customer.

(4) Examination of Exchange and Return Requests:

The store will examine return requests submitted by the customer according to the aforementioned regulations. If the product meets the return conditions, the store will process the customer's request. However, if the request violates the previous return conditions, the store will not be able to fulfill the customer's request.
In the case of an exchange, the price difference will be taken into account. If the new products are more expensive than the products to be exchanged, the customer must complete the payment process. If the new products are less expensive than the products to be exchanged, the store will refund the outstanding amount to the customer. The customer will bear any fees related to payment or refunds in case of order cancellation or product exchange.
If the customer refuses to receive the products despite them conforming to specifications, the order will be canceled, and the customer will bear the shipping fees and all payment-related fees (payment, refund).

(5) Refund Period:

If the customer's return request is accepted, Darbk Store will refund the customer within 15 days from the date of the return request, using the same payment method provided by the customer during the purchase. Please note that this period may increase or decrease depending on the processing time taken by banks and electronic payment service providers.

(6) Rejection of Return Request:

If a return request is rejected after being submitted by the customer and reviewed by the store's specialized returns department, the customer will not be able to recover any paid amounts, and the transaction will be considered a valid sale.

Our team or the shipping company will receive the tires from the customer, inspect them through the store's dedicated returns inspection department, and respond to the customer through the available communication channels.

Eighteenth: Ratings Policy

Darbk Store provides a rating and comment submission service to customers after each purchase, with the aim of providing better service to all our customers and improving the services and tires we offer. The following conditions apply to adding comments:

Ratings must be honest, reflect the service provided, and not be arbitrary. The customer undertakes to use appropriate language during the rating process and not to overstep boundaries in any way. The customer also undertakes that their rating will be objective and not intended to undermine Darbk Store or the tires offered for sale through it.
The customer undertakes that ratings will not be offensive to us or others, or to our or others' trademarks. They also undertake that ratings will not be for political purposes, incite hatred or racism, or disparage religions or cultures.
During the rating process, the customer undertakes not to make any comparisons between the tires advertised on Darbk Store and any third-party products with the aim of disparaging our products or third-party products.
It is prohibited to post any advertisements or promote goods or services through Darbk Store's rating service, and it is prohibited to exploit the service for any promotional purpose, whether for paid or free services.
Darbk Store has the right to process and review all ratings before publishing them and reserves the right not to publish comments if they are illegal or dishonest in our opinion.
Darbk Store reserves the right to delete any comments posted if they violate the preceding provisions or any of the terms and conditions, the sales agreement, or the privacy policy.
Darbk Store reserves its legal right to take legal action in case of abuse against us through the comments service. This includes our right to impose any punitive sanctions on the offender and any fines and compensation due to the store.
Third parties who have been offended through the comments service have the right to take legal action against the customer who posted the illegal comments, without recourse to us. Darbk Store will provide assistance to the judiciary if officially requested to do so.

Nineteenth: Acceptable Use Policy

Darbk Store services are available in the Kingdom of Saudi Arabia, and you acknowledge and agree that you are bound by all terms and conditions stipulated in this agreement, regardless of your country of origin, the country from which you access Darbk Store, or the country where you receive Darbak Store services.
The Darbk Store user undertakes to ensure accuracy when entering the required information into Darbk Store. The user is responsible for periodically reviewing that information to correct, amend, or update it whenever new information becomes available, provided that they retain all supporting data and documents.
All information disclosed by a Darbk Store user must be true, updated, accurate, represent them, and comply with what is required in our registration form. If the user provides incorrect, inaccurate, outdated, or incomplete information through Darbk Store, or if we have reasonable grounds to suspect that this information is incorrect, inaccurate, outdated, incomplete, or does not comply with the (Agreement), then without prejudice to any other rights under this agreement or law, we will suspend or cancel the user's membership or block their access to the store.
Darbk Store must be used for legal purposes. It is prohibited to exploit Darbk Store to achieve illicit or illegal purposes, or purposes that contradict Darbk Store's goals and aspirations.
It is prohibited to broadcast any illegal content, messages, or comments, or those that include abuse towards any of our users, whether they are users, customers, or visitors. It is also prohibited to harm other individuals and third parties through Darbk Store.
Using Darbk Store for political purposes is prohibited, including the user publishing slogans or phrases that support or oppose political ideas through Darbk Store. The user will be solely responsible for such use before the competent authorities.
The user must follow all instructions issued by Darbk Store management regarding the use of Darbk Store's services. In case of violation, the store reserves the right to take all appropriate measures.
The user must notify us if they discover any illegal use of Darbk Store's services or any transactions prohibited by this agreement or applicable regulations.
Users of Darbk Store are obligated not to misuse the data of any party, to respect the privacy policy, and to maintain the confidentiality and privacy of data, and not to exploit it without obtaining the owner's written consent.
The Store has the right to cancel or suspend the membership of any registered user in Darbk Store, whether an individual or an entity, in the event of a breach of any of the terms and conditions contained in this agreement.

Twenty: Third Parties

Darbk Store utilizes third parties such as app stores, hosting providers, payment service providers, and service providers through Darbk Store to deliver Darbk Store's services. These parties do not have a direct relationship with the user; however, their work is essential for the user to fully benefit from Darbk Store's services. Therefore, the user agrees to the third parties we engage to provide services and accepts the use of their services.
We may provide external links through Darbk Store or share our services through other websites or applications. Therefore, you acknowledge and agree that you may be redirected to other websites or applications when sharing services or clicking on external links.
You understand that third parties may apply their own terms and conditions and privacy policies for the use of their services. Therefore, you must review them before using these third parties' services. Darbk Store will not be responsible for drafting or enforcing these terms and policies, and you accept them at your own risk.

Twenty-One: Copyrights

Darbk Store and the ideas expressed within it are the exclusive intellectual property rights of Darbk Store in the Kingdom of Saudi Arabia. Any imitation or appropriation of the Store or some of its services (including ideas, texts, codes, and software) constitutes an infringement of our copyrights, and we will take all legal actions against the perpetrator of such infringements.
All content of Darbk Store, such as (texts, logos, images, graphics, audio recordings, button icons, digital content, downloadable materials, software, and data compilations), is the property of the Store, and is protected by the laws of the Kingdom of Saudi Arabia and international copyright laws.
The compilation of all data included in Darbk Store's services or made available by any of our services is the exclusive property of Darbk Store, and is protected by Saudi and international copyright laws, as well as by applicable international agreements, such as the Berne Convention and the TRIPS Agreement.

Twenty-Two: Trademarks

“Darbk Store” or “darbk.com” and its associated logos, as well as images, logos, page headers, button icons, scripts, and service names, are trademarks, service marks, and trade designs of Darbk Store.
Reproduction of Darbk Store's trademarks or trade designs in any media or advertising without our written permission is prohibited. Furthermore, Darbk Store's trademarks and trade designs may not be used in connection with any product or service not affiliated with us, so as not to diminish the reputation and credibility of Darbk Store or its customers.
Trademarks belonging to other companies may be provided through Darbk Store. These are subject to the rights of their respective owners, and therefore, these companies have the right to take legal action against anyone who infringes upon their trademarks.

Twenty-Three: Granted Licenses

We license you to use our services only in a legal manner. The use of any of our services in an illegal manner or in a way that conflicts with our terms and conditions is prohibited. We reserve the right to exercise our legal rights under this agreement at any time, and you acknowledge and agree that all rights not expressly granted to you in this agreement are reserved by Darbk Store and you shall not have the right to use them.
We provide Darbk Store services under a licensing system, and Darbk Store grants you a limited, non-exclusive license to use Darbk Store. You are prohibited from assigning the license to third parties or sublicensing it without the consent of Darbk Store.
We grant you a license for non-commercial use of our services. Therefore, you are prohibited from using Darbk Store or any of its services for commercial purposes without our consent. This license does not include any copying of account information for the benefit of third parties, or any use of data extraction tools or similar data gathering and extraction tools. Furthermore, this license does not include the resale or any commercial use of any of our services or their contents.
You may not copy the lists of tires offered for sale through Darbk Store, nor may you copy tire names, descriptions, prices, or any advertising content related to tires available through Darbk Store.
You may not reproduce or create a duplicate of this Darbk Store, or copy, sell, or resell any part of it, or use it for commercial or non-commercial exploitation without the express written consent of Darbk Store.

Twenty-Four: Complaints and Solutions

Darbk Store receives complaints, inquiries, and reports, and provides technical support within the scope of Darbak Store's electronic operations and system, including the processing of purchase, shipping, and return requests.
We reserve the right to take administrative actions within Darbk Store in the event of any violation of the Terms and Conditions and Privacy Policy. This includes temporarily or permanently suspending membership or settling any outstanding financial dues.
Darbk Store is not a dispute resolution body or an arbiter of judgments. Therefore, our role is limited to receiving administrative complaints within Darbk Store and attempting to resolve them amicably.
Should one party blackmail, threaten, or harm another party or a third party, the aggrieved party may inform Darbk Store. Our role in such a case is limited to investigating the report, suspending membership, or taking action within our authority against the offending party. However, the aggrieved party must also immediately inform the security authorities.

Twenty-Five: Disclaimer

(1) Disclaimer Regarding Darbk Store:

Darbk Store constantly strives to provide its electronic services optimally, utilizing all modern technologies, software, and necessary protection methods, in addition to taking appropriate legal measures. However, Darbk Store does not guarantee that the services, or any part thereof, will function on all devices used to access the store. Furthermore, even on devices where Darbk Store operates, delays or malfunctions may occur due to internet network issues. Therefore, you release us from liability for all such occurrences.
We provide Darbk Store services as they are available at the time of your visit. The provision, development, continuation, deletion, modification, or updating of services is subject to Darbk Store's discretion. Consequently, Darbk Store does not guarantee that the services will meet all user expectations or fulfill all their needs as an electronic marketplace.
You acknowledge that the internet is not a completely secure medium. Therefore, Darbk Store provides no guarantees that its services, the Darbk Store itself, its servers, or any messages sent are free from viruses or other harmful components.

We offer no guarantees regarding user reliance on this information, and users must fully verify it before doing so. The information we provide may be incomplete, deficient, contain errors, be outdated, or otherwise, and we accept no responsibility whatsoever for it.
All information provided by users is furnished at their sole risk. Darbk Store assumes no responsibility for this information, and the user bears full responsibility for its provision. Other users also bear full consequences should they rely on it. Darbk Store offers no warranty and accepts no liability regarding the recency, prevalence, accuracy, or quality of information that users receive or access through Darbk Store.

(3) Disclaimer Regarding Identity Verification:

Darbk Store cannot confirm that every user of the store is indeed the person they claim to be. Despite collecting accurate and specific data about each user, we offer no guarantees regarding the matching, completeness, or accuracy of any user-provided data.

(4) Other Disclaimer Clauses

The disclaimer clauses are not limited to those contained in this section; rather, any other disclaimer clauses found in any section of these Terms and Conditions or in any other provisions of the Agreement shall also apply.
Any other disclaimer clauses contained in any applicable laws shall apply, whether these clauses were stipulated prior to your use of the store or subsequent to your use of the store.

(5) Time and Place of Disclaimer

All terms and clauses of disclaimer or mitigation thereof contained in this Agreement are not tied to a specific time or place and apply fully to Darbk Store's relationship with its users.
The disclaimer clauses apply to the fullest extent permitted by law. Should any disclaimer clause be excluded by a judicial ruling or a mandatory legal provision, this shall not affect the enforcement of any other clauses stipulated in this Agreement.

Twenty-six: Legal Responsibility

The user expressly agrees that they use Darbk Store at their own personal risk. The user must comply with all applicable laws, regulations, and decisions within the Kingdom of Saudi Arabia, as well as any guidelines, instructions, or rules related to their use of the store. The user bears the resulting legal responsibility in case of breaching these laws, regulations, or decisions, and also undertakes to comply with the Terms and Conditions stipulated in this Agreement.
The user bears full legal responsibility in the event of using our services fictitiously, for purposes of forgery, counterfeiting, deception, or for submitting fake or unserious purchase orders, or with the aim of disturbing us, or using any of our services illegally.
The user bears full legal responsibility in the event of not receiving the tires by the agreed-upon date, failing to pay any fees or dues related to the tires, or providing any false, inaccurate, or incomplete data.
The user undertakes to use Darbk Store and the tires purchased or obtained through it with utmost seriousness and integrity. The user shall be liable to compensate Darbk Store for any losses or damages incurred as a result of any unauthorized or unlawful use.
The user undertakes not to use Darbk Store or any service provided through the store in an illegal, fraudulent, or any other manner that violates applicable laws.
The user undertakes not to send any information, data, content, or messages that include offensive phrases or words to Darbk Store, any of its users, or our affiliated or contracted service providers.
In the event of a user breaching any of the terms or conditions of this Agreement, Darbk Store has the right to suspend or cancel the membership. The user is not entitled to register with Darbk Store again except with the express consent of Darbk Store. This does not prejudice the right of the store or affected parties to take all resulting legal actions.
Darbk Store reserves the right to recover any outstanding amounts or compensation from the user under this Agreement or arising from any breach of the Terms and Conditions, Privacy Policy, use of the application, or the principle of good faith in dealings. To this end, the store has the right to take all legal and judicial measures, with the user being responsible for court costs and attorney fees.
Darbk Store reserves its full legal rights at all times. The failure to exercise a right at a particular time does not constitute a waiver of that right in favor of the user or a third party, nor a waiver of the right itself. We reserve the right to exercise our rights at the appropriate time determined by the store management.

Twenty-seven: Compensation

Darbk Store does not offer any type of compensation other than what is stipulated in the Return Policy, nor does the store provide any other compensation to users. The user accepts settlement based on the compensation outlined in this Agreement.
Should you violate any rights related to Darbk Store, defame us, misuse our products, or breach the Terms and Conditions in any way, we reserve the right to pursue legal action against you and claim compensation, court costs, and attorney fees.

Twenty-eight: Transfer of Rights and Obligations

Darbk Store has the right to transfer all its rights and/or obligations stated in this Agreement or arising from its application to a third party without requiring the user's consent or providing any prior legal or electronic notices. All Darbk Store users subject to the provisions of this Agreement are obligated to fulfill all their obligations stated therein towards the assignee immediately upon our transfer of rights or obligations. The assignee has the right to take all legal actions against any user who fails to fulfill their obligations under this Agreement.
No user has the right to assign their obligations and/or rights stated in this Agreement or arising from its application without obtaining our written consent. Any assignment made otherwise shall be null and void and not legally binding against Darbk Store, and the user remains fully committed to fulfilling their obligations towards us.

Twenty-nine: Amendments

We may modify or update these Terms and Conditions ("Agreement") for using Darbk Store at any time. We will update the "Last Updated Date" at the top of this document, so you should review this Agreement every time you make a purchase through the store.
We may, at any time, make any modifications or improvements to Darbk Store that we deem necessary to enhance its effectiveness, and the user shall comply with any directives or instructions provided by Darbk Store in this regard.
You agree to abide by all additional terms and conditions that will be made available to you concerning the use of any services offered through Darbk Store, and these additional terms and conditions are hereby incorporated into this agreement.

Thirty: Communications

You agree to receive communications from us, and we will communicate with you via email, mobile number, by posting notices on Darbk Store, or through other Darbk Store services.
You agree that all agreements, notices, and other communications we provide to you electronically satisfy all legal requirements as if these communications were in writing, and they shall have the same legal effect.
If you decide at any time that you do not wish to receive promotional messages via the contact information you provided, you can disable the receipt of these messages by contacting us. However, in this case, we cannot guarantee your full enjoyment of our services.

Thirty-One: Notices

Any notices required to be given to Darbk Store under this agreement must be sent through the means provided by us within Darbk Store.
Any notices Darbk Store wishes to send you will be either by posting them on Darbk Store or by sending them to you via the mobile number or email address you provided during the registration process. You are deemed to have received notice as soon as it is posted on Darbk Store or as soon as the message is sent to you.

Thirty-Two: Termination of Agreement

We reserve the right to terminate this agreement with the user if it is proven that they have breached any clause or provision of this agreement, while retaining all our rights to claim compensation for any resulting damages. This also applies in cases of assigning or sub-leasing the account without our consent, or if the user fails to comply with any obligations stipulated in this agreement without taking serious steps to remedy such breach, or if we are unable to verify any information you have provided, or if we determine at any time that the user's activity may cause legal disputes for them or other users, or in the event of the cessation of Darbk Store's operations, or the cessation of activities by those responsible for managing Darbk Store. In all cases, termination shall take immediate effect from the time of the violation, without the need for prior notice, excuses, or judicial claim, and Darbk Store reserves all its legal rights to compensation.
In the event of termination of this agreement for any reason, the user shall remain legally bound to fulfill all legal obligations arising from the application of this agreement prior to its termination.

Thirty-Three: Governing Law and Competent Courts

This agreement and its annexes are governed by the applicable and effective laws within the Kingdom of Saudi Arabia. The judiciary within the city where the headquarters of the entity owning Darbk Store is located shall have jurisdiction over any dispute that may arise from the interpretation or implementation of the provisions of this agreement, or any dispute involving Darbk Store and the customer or any of Darbk Store's users. Should any provision of this agreement become invalid, illegal, or unenforceable, the legality and enforceability of the remaining provisions shall not be affected in any way by that provision.

Thirty-Four: Language

The Arabic text of this agreement shall be considered the authoritative text for the purposes of interpreting and implementing its terms and conditions. In the event of any conflict between the Arabic text and the translated text of this agreement, it is agreed that the Arabic version of this document shall prevail and be enforced.

Thirty-Five: Agreement Inquiries
